Summit Speaker Agreement 

SUMMIT SERIES

Agreement pertains to participation in any of the Summit series for Mental Fitness Institute (DBA of Hickman & Hickman, LLC ) with Susan E. Hickman, PhD, PsyD,  and Guest/Speaker.
 

SPEAKER AGREEMENT

Dr. Susan Hickman of Hickman and Hickman LLC doing business as Mental Fitness Institute (herein referred to collectively as Dr. Susan Hickman) desires to electronically record Guest/Speaker’s presentation/interview via audio and/or video recording (typically on Zoom platform).

Guest/Speaker understands that for educational, promotional and commercial applications, Dr. Susan Hickman will make Guest/Speaker’s presentation/audio/video interview recording available at no charge for attendees of this virtual interview series.

Examples of intended use for the interview series include use in current Summit presented by Mental Fitness Institute, excerpts included in podcast by Mental Fitness Institute or Dr. Susan Hickman (e.g., The Mind of the Matter podcast) or excerpts used by sister non-profit (Mental Fitness Education), inclusion in memberships or other programs available at Mental Fitness Institute, giveaways at conferences to engage attendees, instruction for clients on website (e.g., MentalFitnessInstitute.com, MentalFitnessEducation.org), etc. However, an exhaustive list of all future possible uses is understandably unknown at the time of recording or Summit series.

Guest/Speaker retains the right to utilize their own recorded presentation/audio/video for any and all promotional uses they desire without notification or compensation to Dr. Susan Hickman. Guest/Speaker’s audio recording will be made available for download 60 days post the summit’s conclusion.

Participation in the summit implies the Guest/Speaker has read this agreement in full and agrees to the following:

1. Once participation is affirmed for the Summit by Guest/Speaker, she or he agrees to schedule and complete recorded interview as scheduled no later than two weeks prior to scheduled Summit launch date unless an alternative schedule was previously agreed upon. This ensures post-production editing can be completed in time for Summit launch and avoids undue stress on all parties due to last-minute cancellations.
2. Guest/Speaker hereby grants Dr. Susan Hickman the right to use her or his name, voice, appearances, likeness, image, words, participation and title or professional designation, in whole or in part, in these Recordings and/or compilations and in any correspondence, publicity, advertising, promotional or other derivative materials based on them. Dr. Susan Hickman has no obligation, however, to make use of the rights granted herein.
3. Guest/Speaker hereby grants Dr. Susan Hickman the unconditional right to reproduce the Recording in any format, and to distribute, sell, prepare derivative works, advertise, and publicize the Recordings without compensation to Guest/Speaker other than benefits obtained via publicity of Guest/Speaker as part of the interview series and resulting sales for the Guest/Speaker. However, Guest/Speaker shall also retain the right to use her or his Recording for any purpose.
4. Guest/Speaker, upon written request to Dr. Susan Hickman, shall be provided with a copy of her or his Recording in electronic format starting 60 days post-Summit conclusion.
5. Because we seek speakers whose work, expertise, and heart missions align with the Summit topic, we anticipate that Guest/Speaker will voluntarily promote their interview for the summit at least once to his/her email list approximately 7-10 days prior to the event and to send at least one reminder the day before the event to ensure the maximum number of people have an opportunity to register for the event. The purpose of this is service-based in that we want the Guest/Speaker and other summit participant’s message to reach as many people as possible to encourage, inspire, and improve their lives. Of course, posting about the Guest/Speaker’s upcoming interview to social media outlets and newsletters (if applicable) is very helpful as well in spreading the word of this powerful and free event. Guest/Speakers may promote as much as they see fit, according their own promotion schedule. Prewritten copy and graphics will be made available to assist Guest/Speakers in promotion efforts and reduce demands on their time. Please discuss any concerns or limitations on promotion with Dr. Susan Hickman prior to recording the interview, as an acceptable promotion plan can generally be reached. If promotional capabilities are insufficient for the purposes of the summit, Guest/Speaker can still be interviewed for other outlets (webinars, podcast, spotlight interview for social media or website, etc.). Honest communication is essential and welcomed.
6. Guest/Speaker is encouraged to make a FREE (or low cost) offer for product or services during her or his presentation/interview if desired. However, this is not a requirement for participation and is intended only for the benefit of the Guest/Speaker in building their database and followers by improving traffic to their own sites.
7. Guest/Speaker represents that she or he has the full right, power and authority to grant this release and to perform all of the provisions thereof.
8. Guest/Speaker agrees to indemnify and hold harmless Dr. Susan Hickman from and against all claims, losses, expenses and liabilities of every kind including reasonable attorney’s fees arising out of unintentional inaccuracy or unavoidable breach of any provision of this Agreement. Guest/Speaker expressly releases Dr. Susan Hickman from any and all claims arising out of the use of the material.
9. This release shall be governed in accordance with the state of Tennessee law, constitutes the entire agreement of the parties, and may be amended only in writing.

SUBMISSION OR PARTICIPATION AS AGREEMENT

Speaker Agreement is published and sent to speakers in advance. Participation in summit (i.e., recording of interview) demonstrates consent to Speaker Agreement terms. Submission of signed copy of Speaker Agreement or email sent to Dr. Hickman or her team attesting to agreement with terms represents agreement to Speaker Agreement terms.
